Agreement to Terms

By accessing our website at kzphotobooth.com or engaging KZ PhotoBooth ("Company," "we," "us," or "our") for photo booth rental services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

These Terms of Service apply to all visitors, clients, and others who access or use our website and services.

Services

KZ PhotoBooth provides full-service photo booth rental experiences for events including weddings, corporate events, school proms, galas, fundraisers, and private parties in Bismarck, North Dakota and surrounding areas.

Services are subject to availability and confirmation of a signed contract and paid retainer. Booking inquiries submitted through our website or HoneyBook platform do not constitute a confirmed reservation until a contract has been signed and retainer received.

Booking, Contracts & Payment

• All bookings require a signed service agreement (contract) and a non-refundable retainer to secure your date
• The retainer is due at the time of contract signing and is non-refundable
• Remaining balances are due 30 days prior to your event date
• Bookings made within 30 days of the event date are subject to a $25 rush booking fee
• Mileage fees apply for events outside Bismarck, Mandan, and Lincoln, ND at $0.70 per mile
• Steaming services for fabric backdrops are available at $25–$50 per backdrop

Cancellations & Rescheduling

• All retainer payments are non-refundable regardless of cancellation reason
• Cancellations made more than 30 days before the event will not incur additional charges beyond the retainer
• Cancellations within 30 days of the event may result in the full balance being due
• Rescheduling requests are accommodated based on availability and must be made in writing
• KZ PhotoBooth reserves the right to cancel services in the event of unforeseen circumstances (severe weather, equipment failure, illness) and will issue a full refund of all payments received in such cases

Intellectual Property & Photography Rights

All content on this website — including text, graphics, logos, images, and design — is the property of KZ PhotoBooth and is protected by applicable copyright and intellectual property laws.

Event photos captured by our photo booths during your rental are delivered to the event host. KZ PhotoBooth retains the right to use event photos for portfolio and marketing purposes unless a written opt-out request is received prior to the event date.

Client Responsibilities

As a client, you agree to:

• Provide accurate event details at the time of booking including venue address, event start time, and setup requirements
• Ensure adequate space at the venue for booth setup (minimum 10' × 10' footprint recommended)
• Ensure access to standard electrical outlets (standard 120V, 15-amp circuit)
• Supervise and be responsible for the conduct of your guests around our equipment
• Accept liability for any damage to our equipment caused by event guests beyond normal wear and tear

Equipment & Operation

KZ PhotoBooth provides fully staffed, operated photo booth experiences. Our trained operators handle all setup, operation, and teardown of equipment.

• Equipment remains the property of KZ PhotoBooth at all times
• Clients and guests may not attempt to operate, move, or modify any equipment
• In the event of equipment malfunction, we will make every reasonable effort to resolve the issue; if services cannot be provided, a prorated refund will be issued
• Setup typically begins 60–90 minutes before your event start time

Backdrop Rentals

Backdrop-only rentals (without photo booth services) are subject to additional terms:

• A contract and retainer are required to reserve any backdrop
• Backdrops not currently in inventory may take up to 2 weeks to source and up to 2 months to deliver — reserve early
• Setup and teardown services are available for an additional $50 fee
• Clients are responsible for any damage to rented backdrops or stands

Limitation of Liability

KZ PhotoBooth shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or website. Our total liability for any claim arising from our services shall not exceed the total amount paid by you for those specific services.

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to severe weather, acts of God, venue access issues, or power failures.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of North Dakota. Any disputes arising from these terms or our services shall be resolved in the courts of Burleigh County, North Dakota.

Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted to this page with an updated date. Your continued use of our website or services after any changes constitutes acceptance of the revised terms.
